Nederlandse kansspelbelasting kan snel een probleem worden voor andere EU-lidstaten
In aanloop naar het commissiedebat fiscaliteit van 11 maart 2026 heeft een brede coalitie van organisaties uit de kansspelsector een gezamenlijke brief aan de vaste commissie voor Financiën gestuurd. In die brief wordt gewaarschuwd voor de gevolgen van de herhaalde verhogingen van de Nederlandse kansspelbelasting voor het functioneren van de gereguleerde markt. De sector vraagt het parlement om ervoor te zorgen dat de toegezegde evaluatie van de belastingverhoging uiterlijk in het tweede kwartaal van 2026 wordt uitgevoerd en dat de resultaten daarvan worden meegenomen in toekomstige fiscale besluitvorming. De vraag is of dat voldoende zal zijn.
GLG wins ECHR case against the Netherlands over Gaming Tax Operator awarded € 1,4 mln. in damages
On 5 November 2021, the Supreme Court of the Netherlands ruled in a case brought against the Netherlands by an operator of gaming machines, the company Wetsteijn in Dordrecht. The Supreme Court confirmed the judgment of the Arnhem-Leeuwarden Court of Appeal of 3 December 2019 that the gaming tax introduced in 2008 on turnovers from gaming machines affected the Wetsteijn company excessively and thereby infringed the right to the undisturbed enjoyment of property as protected by the First Protocol to the European Convention on Human Rights. Citizens and businesses often invoke this treaty provision. However, it is the first time that an appeal in a tax case has led to substantial compensation. The groundbreaking ruling of the Supreme Court also offers the prospect of compensation for other operators, who have been litigating for years. The decision of the Supreme Court is final and there are no further legal remedies available.

In zijn recente blog merkt de voorzitter van de Kansspelautoriteit op dat de sector, in zijn woorden, een zeker “bling bling” karakter heeft. Vanuit die observatie trekt hij twee conclusies. Op beide punten heeft hij geen ongelijk, al is die visie wel onvolledig.
